1. About us and these terms

These terms apply when you use this website or buy from VORTEXION ("we", "us"). We are an online store that operates from outside New Zealand and sells to customers in New Zealand. Contact: contact.vortexcore@gmail.com. By placing an order you agree to these terms, our Shipping Policy, our Refund Policy and our Privacy Policy.

Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other New Zealand law that cannot be excluded.

2. Our products

We try to describe and show our products accurately. Colours may look slightly different on your screen. Descriptions, images and specifications come from our suppliers and may be updated. If a product does not match its description, see "Consumer guarantees" below.

3. Placing an order

When you place an order you are offering to buy. We accept your order when we send you an email that it has been dispatched. We may decline an order, for example if the product is unavailable, there is a pricing error or we suspect fraud. If we decline or cancel an order after you have paid, we will refund you in full.

4. Prices and payment

All prices are in New Zealand dollars. The price at checkout is the total you pay to us. Standard shipping to New Zealand is free. We are not currently registered for GST in New Zealand, so we do not add GST. If this changes, the price shown at checkout will include GST. By paying, you confirm you are allowed to use the payment method. If we notice an obvious pricing error, we may cancel the order before we accept it and refund you.

Kit pricing. The Essential Kit is 1 scrubber with 3 brush heads, the Home Kit is 2 scrubbers with 6 brush heads each, and the Ultra Pro Kit is 3 scrubbers with 9 brush heads each. The price of each kit covers all the scrubbers it includes, and when you add more than one kit to your cart the price is multiplied accordingly.

5. Delivery

Delivery times are estimates. See our Shipping Policy for details. We are responsible for your order until it is delivered to the address you gave us.

6. Returns, refunds and our 30-day guarantee

You may return your order within 30 days of delivery for a refund of the product price, as explained in our Refund Policy. Returning only part of a kit is explained in the Refund Policy. This is in addition to your legal rights.

7. Consumer guarantees

If you buy for personal, domestic or household use, New Zealand law gives you guarantees, including that products are of acceptable quality, fit for their normal purpose, match their description and are free from defects. If a product does not meet these guarantees, you may be entitled to a repair, a replacement or a refund. We do not exclude these guarantees.

8. Reviews and customer content

Our website shows reviews of our products. Some reviews may be of the same product from other marketplaces where it is sold, as well as reviews from customers of VORTEXION. Reviews are the opinions of the people who wrote them, not ours. We do not remove a review because it is negative. We may remove content that is unlawful, abusive, spam or not a genuine review.

If you submit a review or other content, you confirm that it is genuine, based on your own experience, and that you have told us about any reward or incentive you received for it. You give us a non-exclusive, free licence to show and use it on our website and in our marketing.

9. Using our website

Use our website only for lawful purposes. You must not interfere with its security or operation, introduce malicious code, scrape or copy it in bulk, or use it to mislead others.

10. Intellectual property

The design, text, images and logos of this website belong to us or our licensors and are protected by law. You may use them for your own personal, non-commercial use. This does not apply to content written by third parties, such as reviews, which remains theirs.

11. Our liability

Nothing in these terms limits liability that cannot lawfully be limited, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. If you buy for business purposes, those Acts may not apply and, as far as the law allows, our liability is limited to the price you paid for the product.

12. Events beyond our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, carrier or customs delays, strikes or outages. This does not limit your rights to a refund or remedy under the law.

13. Privacy

We handle your personal information as described in our Privacy Policy.

14. Changes to these terms

We may update these terms. The version that applies to your order is the one on this page when you placed it.

15. Governing law

These terms are governed by the laws of New Zealand. You and we may bring a claim in the New Zealand courts. This does not take away any rights you have to bring a claim elsewhere where the law gives you that right.
